This Site is for informational purposes. Actual products and services are provided under separate agreements.

3. Intellectual Property

3.1 EPU Engineering Content

All content on this Site—including text, graphics, logos, images, and software—is the property of EPU Engineering LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may:

View and download content for personal, non-commercial use
Share links to our Site

You may NOT:

Reproduce, distribute, or create derivative works without permission
Remove copyright or trademark notices
Use our content for commercial purposes without written consent

3.2 Trademarks

Wayside Maintenance Monitoring System

Use of these trademarks without express written permission is prohibited.

3.3 RWTS Specification and Open Source

The RWTS specification is published under the Apache License 2.0. You may use, modify, and distribute the specification in accordance with that license.

The RWTS trademark remains the property of EPU Engineering LLC. Use of the RWTS name to describe compliant implementations is permitted, but you may not:

Claim official certification without EPU Engineering authorization
Use the RWTS name in a way that implies endorsement
Register domain names or trademarks confusingly similar to RWTS

3.4 Third-Party Trademarks and Logos

This Site may display logos, trademarks, and trade names of third parties, including but not limited to:

Railroad companies and transit authorities
Equipment manufacturers

These third-party marks are the property of their respective owners. Their display on this Site:

Is made with permission of the trademark owner
Does not imply endorsement of EPU Engineering by the trademark owner (unless explicitly stated)
Does not imply endorsement of the trademark owner by EPU Engineering (unless explicitly stated)
Does not grant you any license to use these marks

For trademark owners: If you are a trademark owner and wish to have your mark removed from this Site, please contact us with proof of ownership and we will promptly address your request.

4. Use Restrictions

5. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPU ENGINEERING SHALL NOT BE LIABLE FOR:

ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED $100 USD.

7. RWTS and Open Source Software

7.1 No Warranty for Open Source

The RWTS specification and any open-source software provided by EPU Engineering is provided "AS IS" without warranty. See the applicable open-source license (Apache 2.0) for full terms.

7.2 No Guarantee of Support

Open-source releases do not include guaranteed support, maintenance, or updates. Commercial support is available under separate agreement.

7.3 Implementation Responsibility

You are solely responsible for your implementation of RWTS. EPU Engineering is not liable for:

Implementation errors
Interoperability issues
Damages arising from your use of RWTS in production systems
Regulatory compliance of your implementation

8. Railroad Industry Disclaimer

IMPORTANT FOR RAILROAD APPLICATIONS:

Information on this Site is for general informational purposes only. Railroad signal and safety systems are subject to:

Federal Railroad Administration (FRA) regulations
AREMA standards and recommended practices
State and local requirements
Railroad operating rules

EPU Engineering does not guarantee that any product or service meets specific regulatory requirements for your application. Consult with qualified railroad signal engineers and regulatory authorities before deploying safety-critical systems.

9. Third-Party Links

The Site may contain links to third-party websites. EPU Engineering:

Does not control these external sites
Is not responsible for their content or practices
Does not endorse them by linking

Access third-party sites at your own risk.

10. Indemnification

You agree to indemnify and hold harmless EPU Engineering, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the Site
Your violation of these Terms
Your violation of any third-party rights

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Duval County, Florida.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EPU Engineering regarding use of the Site.
