1. Acceptance of Terms

By accessing or using the EPU Engineering website at epuengineering.com (the “Site”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the Site.

2. Description of Services

EPU Engineering LLC (“EPU Engineering,” “we,” “us,” or “our”) provides information about:

The Railroad Wayside Telemetry Standard™ (RWTS™)
Our software products (Wayside Sentinel, Wayside Overwatch, Wayside Nexus)
Our consulting and engineering services

This Site is for informational purposes. Actual products and services are provided under separate agreements.

3. Intellectual Property

3.1 EPU Engineering Content

All content on this Site—including text, graphics, logos, images, and software—is the property of EPU Engineering LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may:

View and download content for personal, non-commercial use
Share links to our Site

You may NOT:

Reproduce, distribute, or create derivative works without permission, except as sections 3.3 and 3.4 and the RWTS specification's license allow
Remove copyright or trademark notices
Use our content for commercial purposes without written consent

3.2 Trademarks

The following are trademarks of EPU Engineering LLC:

EPU Engineering (name and logo)
RWTS and Railroad Wayside Telemetry Standard
WMMS and Wayside Maintenance Monitoring System
Wayside Sentinel
Wayside Overwatch
Wayside Nexus

Product names and logos may not be used without express written permission. The RWTS marks are different: you may use them to describe an implementation, as set out below.

3.3 Describing RWTS Support

If your product genuinely implements the specification, you may describe it using any of the following. Copy them as written.

“Implements RWTS™ v1.0, profile rwts-mqtt-v1”
“RWTS™-compatible”
“Supports the Railroad Wayside Telemetry Standard™ (RWTS™)”
“Conformance to RWTS™ v1.0, profile rwts-mqtt-v1, is self-declared by [your company]”

Mark the first prominent use of either name with ™. State the specification version and the conformance profile, since a claim without them says nothing an integrator can rely on.

This is a limited permission to describe an implementation accurately, and nothing more. We may withdraw it at any time if the marks are used in a way that misleads, implies endorsement or certification, or misstates conformance.

3.4 RWTS Specification and Reference Library

The RWTS specification is published under the Creative Commons Attribution 3.0 Unported license (CC BY 3.0). You may read, implement, modify, redistribute, and translate the specification, including in closed-source and commercial products. If you redistribute or adapt the specification document itself, that license requires you to credit EPU Engineering LLC. Implementing the standard in your own product is not a use of the document, and carries no attribution requirement, no fee, and no obligation to EPU Engineering.

The RWTS Python reference library is licensed separately under AGPL-3.0-only. The reference library is not required in order to implement the specification. Commercial licensing of the reference library, for use in products that cannot accept the terms of AGPL-3.0-only, is available from EPU Engineering under separate agreement.

The RWTS trademark remains the property of EPU Engineering LLC. Use of the RWTS name to describe an implementation is permitted, provided you state the specification version and profile it implements. An RWTS certification program is in development and not yet available; until it launches, conformance is self-declared. You may not:

Claim that an implementation is certified, approved, or verified by EPU Engineering
Use the RWTS name in a way that implies endorsement
Register domain names or trademarks confusingly similar to RWTS

3.5 Third-Party Trademarks and Logos

This Site names trademarks and trade names of third parties, including but not limited to:

Railroad companies and transit authorities
Equipment manufacturers and prior employers of our principal
Industry organizations and standards bodies

These third-party marks are the property of their respective owners. Their display on this Site:

Is a nominative reference, made solely to identify the owner's goods, services, or standards
Does not imply endorsement of EPU Engineering by the trademark owner (unless explicitly stated)
Does not imply endorsement of the trademark owner by EPU Engineering (unless explicitly stated)
Does not grant you any license to use these marks

If you believe a trademark is displayed improperly on this Site, contact us at contactus@epuengineering.com.

For trademark owners: If you are a trademark owner and wish to have your mark removed from this Site, please contact us with proof of ownership and we will address your request.

3.6 Ideas and Submissions You Send Us

Do not send confidential information. Our contact forms and email are not confidential channels. Nothing sent through them is received in confidence, and you should not send material you are obliged to keep confidential for someone else. Confidential exchanges happen only under a written agreement signed in advance.

Submissions are non-confidential and non-proprietary. Any idea, proposal, change request, problem report, or other material you send us without a signed agreement may be used freely. You grant EPU Engineering LLC a perpetual, irrevocable, worldwide, royalty-free license to use, modify, publish, and incorporate it into any product, service, or specification, without compensation or obligation to you. We receive similar suggestions from many sources and develop continuously, so our building something similar to your idea creates no claim against us. This section does not apply to résumés, teaming inquiries, or other personal information you send about yourself, which we handle only as described in our Privacy Policy.

By submitting, you confirm the material is yours to send and infringes nobody's rights. Please describe what you need in your own words rather than sending source code — the contributing policy explains why.

4. Use Restrictions

You agree NOT to:

Use the Site for any unlawful purpose
Attempt to gain unauthorized access to our systems
Interfere with the Site's operation or security
Scrape, crawl, or harvest content without permission
Upload malicious code or content
Impersonate EPU Engineering or our employees
Use automated tools to access the Site (except search engine crawlers respecting robots.txt)

These restrictions apply to the content of this Site. They do not restrict the RWTS™ specification, which is openly licensed and may be redistributed under the terms in section 3.4.

5. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

WARRANTIES OF MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR COMPLETENESS OF INFORMATION

EPU Engineering does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Pre-release and planned capability. RWTS™ v1.0.0 and the products described on this Site are under active development. Descriptions of features, counts, schedules, and capabilities state our current intent. They are not commitments and may change without notice before release. Do not make purchasing, procurement, design, or scheduling decisions in reliance on a description of unreleased capability. Ask us in writing instead.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPU ENGINEERING SHALL NOT BE LIABLE FOR:

ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE TOTAL AMOUNT, IF ANY, YOU PAID TO EPU ENGINEERING FOR ACCESS TO THE SITE.

This Site is provided free of charge, and these Terms cover the Site only. Work performed under a signed engineering or commercial agreement is governed by that agreement, including whatever liability provisions it contains.

Some jurisdictions do not allow the exclusion or limitation of certain damages. Where that is so, the exclusions and limits above apply to the greatest extent the law permits, and nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.

7. RWTS and Open Source Software

7.1 No Warranty for Open Source

The RWTS specification and any open-source software from EPU Engineering are provided “AS IS” without warranty. See the applicable license for full terms — CC BY 3.0 for the specification, AGPL-3.0-only for the reference library.

7.2 No Guarantee of Support

Open-source releases do not include guaranteed support, maintenance, or updates. Commercial support is available under separate agreement.

7.3 Implementation Responsibility

You are solely responsible for your implementation of RWTS. EPU Engineering is not liable for:

Implementation errors
Interoperability issues
Damages arising from your use of RWTS in production systems
Regulatory compliance of your implementation

8. Railroad Applications and Professional Advice

IMPORTANT FOR RAILROAD APPLICATIONS:

Information on this Site is for general informational purposes only. Railroad signal and safety systems are subject to:

Federal Railroad Administration (FRA) regulations
AREMA standards and recommended practices
State and local requirements
Railroad operating rules

EPU Engineering does not guarantee that any product or service meets specific regulatory requirements for your application. Consult with qualified railroad signal engineers and regulatory authorities before deploying safety-critical systems.

Nothing on this Site is professional engineering advice. These pages are general information about our work, our products, and the RWTS™ standard. They are not an engineering opinion, a design, a certification, or a recommendation for any particular installation, and they are no substitute for a licensed professional engineer reviewing your specific application.

Using this Site creates no engineer-client relationship. Reading these pages, downloading the specification, or sending us a message through a contact form does not engage EPU Engineering, does not create a professional or contractual relationship, and does not make us responsible for your project. We accept engineering work only under a written agreement signed by both parties and scoped to a defined engagement.

9. Third-Party Links

The Site may contain links to third-party websites. EPU Engineering:

Does not control these external sites
Is not responsible for their content or practices
Does not endorse them by linking

Access third-party sites at your own risk.

10. Indemnification

You agree to indemnify and hold harmless EPU Engineering, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the Site
Your violation of these Terms
Your violation of any third-party rights

11. Modifications to Terms

We may modify these Terms at any time. Changes are effective when posted to the Site. The “Last Updated” date indicates the most recent revision. Continued use after changes constitutes acceptance.

12. Termination

We may terminate or suspend your access to the Site at any time, without notice, for any reason, including violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Duval County, Florida.

14. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EPU Engineering regarding use of the Site.

Parts of the Site are offered in Spanish and Portuguese for convenience. These Terms and the Privacy Policy are published in English only, and the English text governs.

16. Authorized Communications

EPU Engineering communicates only from the domain epuengineering.com. We do not operate lookalike domains, do not conduct business from free webmail accounts, and never request payment, banking details, or changes to payment details through this Site or by unsolicited message. We have no open positions unless this Site says so, and we never ask prospective employees, teaming partners, or subcontractors for fees, identity documents, or account details.

We have no resellers or authorized partners. Nobody may sell, quote, license, or contract for our products or services on our behalf, or describe themselves as affiliated with or acting for EPU Engineering, without a written agreement signed by us.

Nobody is authorized to issue RWTS™ certification. The certification program is in development and not yet available, so any offer to certify, approve, or validate an RWTS implementation is not genuine. Conformance is self-declared by the implementer.

If a communication claims to come from EPU Engineering and you are unsure, do not act on it. Write to contactus@epuengineering.com using the address as written here, not one supplied in the message you received.
